By accessing or using this site and the related storefront, apps, and services (the “Services”), agreement to these Terms of Service is made, along with any policies referenced here such as Privacy Policy, Refund Policy, and Shipping policy. If these Terms conflict with other posted policies for a specific feature, those feature‑specific terms control. Continued use means acceptance of updates posted here.

This store is powered by Shopify. Shopify provides the e‑commerce platform and may process data to support the Services; however, any contract of sale is solely between Berjaya and the customer, and Berjaya is the merchant of record. Access to third‑party Apps or services via Shopify is provided for convenience and is governed by those providers’ terms.

Personal information is collected and used in accordance with the posted Privacy Policy, which forms part of these Terms. Shopify’s own terms and privacy notices may also apply to features powered by Shopify, such as checkout or order tracking.

Section 11 – Feedback

Any feedback, ideas, proposals, reviews, or other content submitted may be used without restriction, provided that the submitter owns or controls the rights to such content and it does not violate any third‑party rights or applicable law. Feedback that is unlawful, abusive, defamatory, obscene, or malware‑related is prohibited and may be removed.

From time to time information on the site may contain typographical errors or inaccuracies that relate to product descriptions, pricing, promotions, offers, shipping charges, transit times, or availability. To the fullest extent permitted by law, Berjaya, its directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind arising from use of the Services or any products procured using the Services, including lost profits, lost revenue, lost savings, loss of data, replacement costs, or similar damages, whether based in contract, tort, strict liability, or otherwise. In jurisdictions that do not allow the exclusion or limitation of liability, liability will be limited to the maximum extent permitted by law.

Agreement is made to indemnify, defend, and hold harmless Berjaya and its affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of breach of these Terms or the documents they incorporate by reference, or violation of any law or third‑party rights.

Section 18 – Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed from these Terms; such determination shall not affect the validity and enforceability of any remaining provisions.

Section 19 – Waiver; entire agreement

Failure to enforce any right or provision shall not constitute a waiver of such right or provision. These Terms and any policies or operating rules posted on this site or in respect to the Services constitute the entire agreement between the parties and supersede any prior or contemporaneous communications and proposals, whether oral or written.

Rights and obligations under these Terms may be assigned to an affiliate or in connection with a merger, acquisition, or sale of assets; users may not assign rights or obligations without prior written consent.

Section 21 – Governing law
